What works once works twice? Ghosts of Galapagos are reappearing. Back when the German heat exchangers group sought to undergo restructuring in the UK, German insolvency lawyer Jan Bayer managed to surprise K&E on the morning - in court - with a filing and acceptance of the case in Germany. As we write, members of the holdout group are fighting the issuer substitution in the Frankfurt regional court. Surely that is not going to happen again.
